Statement of Intent and Justification

This legislation safeguards the constitutional and emotional rights of children to maintain meaningful relationships with both parents. Repeated interference with visitation has long been treated with minimal sanctions, allowing alienation to persist and causing profound psychological damage.
The New York Alienation Act (Protection of Parent and Child Relationship) establishes clear, enforceable penalties—including fines, custody modification, and, where necessary, short-term incarceration—to ensure accountability and end the cycle of repeated violations. Its goal is to protect children from emotional harm and restore fairness and balance within New York’s Family Court system.
